Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and drivingtest.irish ("we", "us", "the service") and govern your use of the drivingtest.irish website and apps. By creating an account or using the service, you agree to these Terms. Please read them together with our Privacy Policy and Cookie Policy.

1. Definitions

  • "Service" means the drivingtest.irish website, apps and related features.
  • "Account" means the personal account you create to use the Service.
  • "Free" features are available without payment; "Pro" features require a paid plan.
  • "Content" means the questions, explanations, text, design and software we provide.
  • "You" means the person using the Service.

2. Acceptance and eligibility

By using the Service you confirm that you are at least 16 years old, that the information you give us is accurate, and that you will keep it up to date. If you are using the Service on behalf of someone else, you confirm you are allowed to do so. If you do not agree with these Terms, do not use the Service.

3. What the Service is

drivingtest.irish is an independent online study tool for the Irish RSA car driver theory test, based on the official set of theory-test questions published by the Road Safety Authority of Ireland (RSA). It provides practice, mock exams, adaptive study tools, learning modules and progress tracking.

We are an independent service. We are not affiliated with, endorsed by, or connected to the RSA, the official Driver Theory Test service, or any government body.

4. A study aid, not the official test

The Service helps you prepare. It is not the official RSA theory test and cannot book, replace or influence your official test or its result. We work hard to keep our questions and explanations accurate and up to date, but we do not warrant that every item matches the current official test, and we do not guarantee that you will pass. The official test is administered solely by the RSA and its appointed provider.

5. Your account

You are responsible for keeping your login details confidential and for all activity under your Account. Accounts are personal: one Account per person, and you may not share, sell, transfer or sublicense your Account or access to it. Tell us promptly at [email protected] if you think your Account has been accessed without your permission. We are not responsible for losses caused by someone using your credentials with your knowledge or through your failure to keep them safe. Repeat and multiple registration is prohibited: you may not create or operate more than one Account (including under a different email address or sign-in provider), register a new Account after yours has been suspended or banned, or register Accounts in bulk — several Accounts created from the same IP address or the same device may all be blocked, together with that device or network. The free trial is a one-time offer per person and device; registering new Accounts to claim it again is prohibited. If you believe a block has affected you unfairly, contact [email protected].

6. Acceptable use

You agree not to:

  • copy, scrape, crawl, resell, republish or redistribute our questions, explanations or other Content;
  • share Pro access with others or use one Account for several people;
  • break, disrupt, overload, reverse-engineer or gain unauthorised access to the Service or its systems;
  • upload anything unlawful, harmful or infringing, or use the Service to harass or harm others;
  • create multiple Accounts, register again after a suspension or ban, or register Accounts in bulk from one IP address or device (including to re-claim the free trial);
  • use automated tools or bots except as we expressly allow.

We may investigate, remove content, and suspend or close Accounts that break these rules, and we may report illegal activity to the authorities.

7. Intellectual property

The Service, its design, software, text and explanations are owned by drivingtest.irish or its licensors and are protected by intellectual-property law. The official theory-test questions remain the property of the RSA. We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the Service for your own private study only. All rights not expressly granted are reserved.

Your own data (such as your answers and progress) remains yours. If you send us feedback or report a problem with a question, you grant us a free, worldwide licence to use that feedback to improve the Service, with no obligation to you.

8. Plans, prices and payment

Practice is free. A Pro upgrade unlocks features such as unlimited mock exams and Smart Practice. Pro is sold as a one-time purchase for a fixed period (for example 1, 3, 6 or 12 months). It is not a recurring subscription and does not renew or charge you automatically — when the period ends, your Account simply returns to Free.

Prices are shown at checkout, in euro, and include any applicable taxes. Payments are processed by our payment providers (Stripe and Revolut); we never see or store your card number. You confirm that you are entitled to use the payment method you provide.

9. Refunds and cancellation

We offer a 14-day money-back guarantee: if you are not happy with Pro, email us at [email protected] within 14 days of your purchase and we will refund it — no explanation needed.

After those 14 days Pro is generally non-refundable, but we review every request individually. If something went wrong — a technical fault, a duplicate or accidental charge, or access you never received — contact us and we will look at your case fairly and put genuine mistakes right.

Nothing here limits the rights you have as a consumer under Irish and EU law. Refunds are made to your original payment method, normally within 14 days of approval.

10. Complaints and dispute resolution

If you have a problem, please contact us first at [email protected] — most issues are resolved quickly and informally. We aim to acknowledge complaints within a few business days and to resolve them as soon as we reasonably can.

If we cannot resolve a dispute directly, you may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. As a consumer you also keep the right to bring proceedings in the courts of your country of residence. We would always prefer to sort things out with you directly before any formal step.

11. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, we do not warrant that it will be uninterrupted or error-free, or that its content is complete, current or fit for a particular purpose. The Service is for study and general information only and is not legal or professional advice. Any reliance you place on it is at your own risk, subject to the mandatory rights you have as a consumer.

12. Limitation of liability

To the extent permitted by law:

  • we are not liable for indirect, incidental or consequential loss, or for loss of profits, data or opportunity;
  • we are not responsible for the result of your official theory test, or for decisions you take based on the Service;
  • our total liability to you for any claim connected with the Service is limited to the amount you paid us in the 12 months before the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded by law — including liability for death or personal injury caused by negligence, for fraud, or for your mandatory rights as a consumer.

13. Suspension and termination

You can stop using the Service and delete your Account at any time from Settings. We may suspend or terminate your access if you breach these Terms, if the law requires it, or if it is necessary to protect the Service or other users; where it is reasonable to do so, we will give you notice. If we terminate your Account without good reason while you hold paid Pro time, we will refund the unused portion. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability and governing law) continue to apply.

14. Governing law and jurisdiction

These Terms, and any dispute arising out of them or the Service, are governed by the laws of Ireland, and the courts of Ireland have jurisdiction. If you are a consumer resident in another EU country, you keep the protection of any mandatory consumer-law provisions of your country of residence, and you may also bring proceedings there.

15. Changes to the Service, features and offers

We are continually improving the Service and may add, change, limit, suspend or remove features, content and functionality at our discretion and at any time.

We may also change our plans, prices and which features are included in the Free and Pro tiers — including the limits on how often Free features may be used — and we may introduce, change, pause or withdraw trials, promotions, bonus offers and discounts, at our discretion and at any time. Such changes are not retroactive: any Pro period you have already paid for keeps the price and the paid features that applied when you purchased it, for the period purchased. Free features and their usage limits, and any promotion, may change or end at any time. Where a change is significant we will update the "last updated" date below and, where appropriate, notify you.

16. Changes to these Terms

We may update these Terms from time to time — for example to reflect new features or legal changes. When we make a material change we will update the "last updated" date below and, where appropriate, notify you. Changes do not apply retroactively. If you continue to use the Service after an update, you accept the revised Terms; if you do not agree, you should stop using the Service and may delete your Account.
